Customer Agreement (End-User License Agreement)

Effective date: September 2, 2026

This Customer Agreement ("Agreement") is a legal agreement between you ("you") and SKJ APPS ("SKJ APPS," "we," "us," or "our"), the publisher of the TrillMark software, and it governs your installation and use of the TrillMark application and any updates we make available under this Agreement (together, the "Software").

By installing, activating, or using the Software, you agree to this Agreement. If you do not agree, do not install, activate, or use the Software.

1. How you obtained the Software, and Setapp

You may obtain the Software directly from us or through the Setapp Marketplace operated by MacPaw ("Setapp").

When you obtain the Software through Setapp, you acknowledge and agree that Setapp acts as the merchant of record for that transaction and is authorized by SKJ APPS to distribute, deliver, and sublicense the Software to you on SKJ APPS' behalf. Your access to the Software through Setapp is also subject to Setapp's own applicable terms, and your purchase, account, billing, and payment matters for that channel are handled by Setapp. This Agreement governs your license to use the Software itself; it does not replace Setapp's terms for the marketplace transaction.

SKJ APPS remains the licensor and owner of the Software regardless of how you obtained it.

2. License grant

The Software is licensed, not sold.

Subject to your compliance with this Agreement, SKJ APPS grants you a personal, limited, non-exclusive, non-transferable license to install and use the Software on Mac computers that you own or control, for your personal or internal business use.

When you obtain the Software through Setapp, your license, the number of devices you may use, and the duration of your access are provided in accordance with Setapp's plan and terms. When you obtain the Software directly from us, your license permits installation and use on up to three (3) Macs that you own or control at one time, and you may deactivate one Mac and move that activation to another Mac you own or control, subject to the activation limits provided with the Software.

A license is intended for use by one individual and may not be shared among multiple users unless we expressly offer and you obtain a multi-user or organizational license.

3. Ownership and intellectual property

The Software is protected by copyright and other intellectual-property laws. SKJ APPS retains all right, title, and interest in and to the Software, including all intellectual-property rights, trademarks, and the TrillMark name and marks. No ownership rights are transferred to you, and no rights are granted except as expressly stated in this Agreement.

4. Restrictions

Except to the extent applicable law expressly permits despite these restrictions, you may not:

5. Updates and future versions

Your license includes updates that we choose to designate as updates to the Software, when and if we make them available. Updates may include bug fixes, compatibility changes, security improvements, and feature changes. We are not obligated to provide any particular update, feature, enhancement, maintenance service, or technical support.

Future major versions, separately branded products, or other products may require a separate purchase. Changes to macOS, Apple technologies, hardware, or third-party services may affect the Software's compatibility, availability, or functionality, and we do not guarantee that the Software will remain compatible with every future change.

6. Third-party software

The Software includes the open-source Sparkle update framework, which is provided under its own applicable open-source license. Nothing in this Agreement restricts any rights granted to you under that license with respect to Sparkle or any other third-party component. Applicable third-party notices may be provided with the Software or on our website.

7. Purchases, merchant of record, and taxes

When you obtain the Software through Setapp, Setapp acts as the merchant of record and handles billing, applicable taxes, invoicing, refunds, chargebacks, and related transaction matters in accordance with Setapp's own terms and policies. When you obtain the Software directly from us, your purchase is processed by our payment provider, which acts as the merchant of record for that sale and handles payment, applicable taxes, and related matters under its own terms.

We do not receive or store your full payment-card details on either channel.

8. Refunds

If you obtained the Software through Setapp, refunds and cancellations are handled by Setapp under its policies. If you obtained the Software directly from us, we offer a 14-day, no-questions-asked refund; to request one, contact support@trillmark.app or use the support options provided with your order within fourteen (14) calendar days of purchase. When a refund is issued, the associated license may be deactivated, and you must stop using and delete the copies of the Software covered by the refunded purchase. This voluntary policy does not limit any refund right or consumer protection that cannot lawfully be waived.

9. Disclaimer of warranties

10. Limitation of liability

11. Termination

This Agreement remains effective until terminated. You may terminate it at any time by stopping use of the Software and deleting all copies in your possession or control. We may terminate this Agreement or deactivate the applicable license if you materially breach it, or in cases involving unauthorized distribution or resale, intentional license sharing, license circumvention or tampering, fraudulent purchase activity, a refunded or charged-back purchase, or unlawful use. Upon termination you must stop using the Software and delete all copies in your possession or control. Provisions concerning ownership, restrictions, disclaimers, limitations of liability, and other terms that by their nature should survive will survive termination.

12. Privacy

Your use of the Software is also subject to our Privacy Policy, available at https://trillmark.app/privacy, which explains what data the Software does and does not process and how it is handled.

13. Changes to this Agreement

We may update this Agreement for future versions of the Software. The version presented to you at the time of purchase or activation will generally govern that purchase, unless a later change is required by law or relates to newly introduced features. We will not retroactively remove material rights associated with a completed purchase without a valid legal basis.

14. General

This Agreement is governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws principles, and nothing in this section deprives a consumer of any protection or forum that cannot lawfully be waived under the laws applicable to that consumer. If any provision is found unenforceable, it will be enforced to the maximum extent permitted or severed, and the remaining provisions will remain in effect. A failure to exercise a right is not a waiver of it. You may not assign this Agreement without our prior written consent; we may assign it in connection with a sale, merger, or reorganization of the Software or related business. This Agreement, together with the Privacy Policy, any applicable Setapp terms, and any third-party license notices, is the entire agreement between you and us concerning the Software.
